Art.29: Separation of the agreement
  1. The "separation of the agreement " describes the steps that a registered member must follow, on his initiative, in order to recover partially or entirely its nominal deposit.
  2. Partial refund. The holder must contact the Management Entity which manages his nominal account. The ME must inform and await the authorization of the District Entity before carrying out the separation order.
  3. Removal petition. The request for a total separation is done directly near the District Entity, and involves the striking off the database and the closing of the nominal accounts of the holder. The District Entity will directly transmit the order to each ME having an account belonging to the holder. The DE will carry out the payment of the sums in accordance with the applicable legislation in its Country.
  4. Public information: the District Entity and the TA will publish the holder's act of separation.
  5. Opposition of third parties: any party having a contract in force with a registered member may be opposed to a total or partial separation request from this participant. In this case, the procedure is suspended and do not restart before the cause of opposition is vanished.
  6. The financial report published immediately after the request of separation will be used as reference for the calculation of the amount and date of refunding, in accordance with the economic reports that the ME transmit to the holder's DE.
  7. On the amount of refunding, the ME will deduct the management fees.
  8. The Return of Exploitation (rights proportional to the nominal deposit on the exploitation funds) is not accounted in the refund calculation.
