Art.77: Calculation of the Compensations
  1. The budget of the compensations is considered an ordinary procedure, and the procedure spokesman receives a mandate to execute it on the account of the censal funds. The decision cannot directly burden the nominal deposit of any part, however, it can order the partial or total reallocation of the nominal deposit as exploitation funds.
  2. Compensations higher than the sum of both part's Insurance Capital are not allowed during the stage of mediation. When only one of the parts is a registered member, the amount is equal to the Insurance Capital of this member.
  3. The Spokesman can directly choose the executive arbitration, without the mediation step. This option becomes compulsory when the claimed compensation exceeds the threshold of procedure.
  4. Operation fees do not apply to agreements and compensation defined in the first step of mediation. The mediator will not be remunerated for this work. Any justified expenditure will have to be negotiated by the parts.
  5. Operation fees which are deducted from the compensations approved by executive arbitration, are as follows:
    1. The fee procedure, subtracted from compensation, is poured to TA;
    2. The agency fee, subtracted from the sums transferred by the Management Entities;
    3. The arbitration fee, which is subtracted from the compensation amount, corresponds to the Spokesman's nominal income, and is subjected to deduction.
  6. A payment approved by ordinary procedure can define complementary methods to access resources, which will be available to the designated Spokesman, such consultancy fees and other charges related to any step of the arbitration.
