V.9. Arbitration

Art.75: General
  1. Am arbitration procedure is the procedure that allows solving litigations between the signatories parts of a private contract in conformity with the provisions of General Agreement. The procedure is described without prejudice of the provisions of the arbitration laws in force in the Country of the parts, and it is conformant with the International Conventions of arbitration (in the method "ad-hoc ").
  2. The plaintiff is the part who requested the procedure, and the defendant the contrary part. To be admissible, the contract under litigation must satisfy the following conditions:
    1. Either the plaintiff or the defendant is a registered member;
    2. The agreement is compliant with the General Agreement and his date is within the time of prescription;
    3. The common clauses of the General Agreement are valid.
  3. The course of the arbitration distinguishes three stages:
    1. The selection of a procedure spokesman.
    2. The mediation, economically bounded by the sum of the Insurance Capital of the two parts, to which the parts can make appeal and request an executive arbitration.
    3. The executive arbitration, with an unbounded amount of compensations, and with no appealing.
  4. Once the mediation, or the arbitration settlement is approved, the execution mandate is assigned to the Spokesman designated by the parts. This Mandatary will be able to make opposition to any arbitration requested by one of the parts, during a minimum time of ONE YEAR, or the duration specified by the mediation or arbitration decision.
  5. The private identity of the individual parts (by using initials) and the confidential information carried by the spokesman or the TA, will be protected.
  6. Once accepted, a decision of arbitration is regarded as final and executory when the parts are professionals or companies. Litigations with individuals are subjected to the specific legislation of the individual.
